I plan to quit my job next month and move back to my home country for less than a year after which I plan to marry my fiancé who is currently on OPT here and apply for a dependent visa (either F-2 or H-4 depending on my fiancé's status at that time) from my home country. Would there be any reasons (such as potential immigrant) for my dependent visa application to get rejected by the consulate due to the fact that I was earlier staying in the US on H-1B visa and that I was on F-1 before that? If I come back to US on the dependent visa within the next 1 year, would I still be subject to the H-1 cap if an employer files an H-1 petition for me? Thanks in advance! Link to comment
t75 Posted March 14, 2013 Report Share Posted March 14, 2013 An H4 is more likely than an F2. You will not be subject to quota but will get only the remainder of 6 years. Link to comment
