Immediate!! Help requested on OPT and H1

Hi Everyone,

This is Swetha and I have a question regarding my H1 which is confusing me from many days. I heard about this forum and hoping to get valuable suggestions that keeps me knowledgable on H1's.

Details:

I am on F1 visa valid till Dec 2013 and my OPT STEM valid till May 2014. I am planning to apply for my H1 this April 2013 and also visiting India in Jun 2013, so is there any problem while re-entry into US.

Questions:

1. What is the good time that I can apply for H1 based on the above details?

2. What is the visa status I will be on if I visit India in Jan2013 on my F1 and applied H1 in Apr 2013?

3. What are the possibilities of applying H1 next year as my OPT is valid till May 2014?

4. If I apply H1 in April 2014, what will be my visa status from Jan 2014 to Oct 2014?

I request any one responding to these details as it is really helpful.

First off, you don't apply for an H1. Your employer can file an application for you.

Second, double-check your dates. The "Jan 2013" date you mention is long past.

You can travel abroad and come back on F1 before October.

My bad actually I meant my employer applying H1 and the corrected date from above comment is Jun 2013.

As per your suggestions I understand that even if my employer applies for H1 in Apr 2013, I can still visit India in Jun 2013 as my visa is valid till Dec 2013. Is that correct? Just wanted to make sure.
