h1bapp2013
I'm in opt stem extension right now (Expires by Oct 30). If I get a new job opportunity, Can I apply H1B with the new employer. Do I need to have pay stubs with new employer? Will there be any issues with the approval process? Link to comment
rahul412
Do I need to have pay stubs with new employer? Will there be any issues with the approval process? Yes, pay-stubs is the proof that you are working in OPT. Without that your employer can't file H1 for you. Link to comment
t75
Any potential employer can file for H1B. You need to provide evidence that you are in legal status in the US for a COS. Pay stubs are the way to do it if you are on OPT. Link to comment

Can I file H1B with new employer? No one in US can file your H1 since you doesn't have latest pay-stubs. You didn't had pay-stubs means you didn't work in OPT which is nothing but you didn't maintain legal status. Link to comment
