We've never had any immigration issues, but greencard was stuck in priority dates not getting current, and we had some personal issues going on. We now want to come back. I have a valid H1-B stamp until September 2014, and an approved I-140. Can I use that (assuming I can get a job) and come back to the US? Will I fall under the quota or can I get an extention using my I-140 without coming under the quota? Will I have to stamp again? Will the interview be waived? Link to comment
