H1B Job Transfer in 6th Year

Recommended Posts

Hello,

Background:

I am currently in 6th year of H1B visa. It expires in September end of 2013. I have couple of international visits back home. After capturing that time, I have time until December end of 2013. My PERM is getting filed in mid March 2013. After that approval, I-140 will be filed and then the 3 year extension.

Current Situation:

I have been getting calls with better offers in other companies who are ready to sponsor H1B visa.

Queries:

Assuming that I transfer to the new company, what all should I be aware of ?

Is it practical to do the transfer with this much short time I have and to start all steps from scratch ?

Would it be helpful to move to L1 status with the new company ?

or

Staying with the current company until extension is filed post PERM and I-140 approval is the only option I have ?

Thanks in advance for the answers to above questions. Your input is valuable.

Regards,

SS

Frankly speaking, you do not have any options. It is highly unlikely that both the PERM and I140 will be approved between March 2013 and December 2013.

Since you have used all the 6 yrs, L visa not an option either.Even if you move to a different company on H1,you get the period whatever is left.
