chalak Posted March 8, 2013 Report Share Posted March 8, 2013 Hi, I have an approved I-140 in EB-3 category and working on EAD with priority date in April 2003. I got an offer from another company who will file my GC in EB 2 category. Multiple questions: 1. Is it possible to retain the priority date from my EB3 application even though my new GC will be filed in EB2 category 2. My job role has changed significantly when my GC was filed initially as a System Analyst to now an executive (GC application has been stuckfor 10+ years). Do I have any other option 2. Can employer file GC in EB2 category prior to me joining them ? Link to comment

An employer can initiate a green card process prior to the beneficiary commencing employment with them. It is advisable to seek the counsel of a qualified immigration attorney. Link to comment
