H1B Second Time

Hi Everyone,

1.My first H1B got approved on Oct 2005. I traveled to USA on March 2006. Changed couple of employers. I returned to India on March 2010(worked 4 years in USA). My H1B expired on May 2011 as per I-94 departure card. Currently I got 2 offers, Company A willing to file H1B & Company B also going to file H1B this April. Could anyone suggest me since i have valid SSN. Will there any be any issue with H1B filing with 2 different employers?

2. Am i eligible for Cap-Exempt? Since i am in india from March 2010?

Generally a person in your situation can choose to be considered not subject to cap, in which case you will only receive the remaining time of your prior H-1B 6-year period, or to be considered cap subject, in which case your petition needs to be filed along with everyone else filing April 1st or soon after.

Generally, it is acceptable to USCIS if 2 different employers file H-1B petitions for the same person.
