Satishroy Posted February 28, 2013 Report Share Posted February 28, 2013 Once I am counted against the H1-B cap, can I have future employers file for cap subject H1-B any time during the year regardless of whether or not the cap for that year has been reached, and start working for them immediately without waiting for the new H1-B application to get approved? Attorney_11 Posted February 28, 2013 Report Share Posted February 28, 2013 Generally, an individual who has been approved for H-1B status and has counted against the cap and has H-1B time remaining is not counted against the cap again when changing employers in the future. Link to comment
