H1stamp2016 Posted February 27, 2013 Report Posted February 27, 2013 Hello everyone, I am in my 6th year of H1 and have to apply for H1- Extension with approved I-140. my employment model is E-V-C , but the vendor is giving me a PO with end date of 3 months from now. and he is not willing to give me an open PO or a further end dated PO I am working with him for the last 1 year, and he says the project will be extended indefinitely.but can only give the PO for 3 months at a time. Please let me know , will this affect the extension of my H1 for 3 years. Thanks in advance Thanks, 2013 H1
Attorney_11 Posted February 28, 2013 Report Posted February 28, 2013 The USCIS will review all documents and determine whether to approve or deny, and if to approve then to what duration to approve till based on a totality of the circumstances after a review of all the evidence presented. It is possible that a short PO may prompt the USCIS to issue a shorter H-1B validity. It may be helpful to review the matter with a qualified immigration attorney to determine the issues and be prepared for possibilities and develop personalized immigration strategy.
H1stamp2016 Posted February 28, 2013 Author Report Posted February 28, 2013 thanks Attorney_11 , My vendor says he would mention the PO end Date ie in 3 months from now and in the end date he would mention that "The project could extend Indefinitely due to the Nature of the work" will this suffice , Please let me know.
