arjunmca Posted February 21, 2013 Report Posted February 21, 2013 Hi, I have two valid I-797's till 2015. I went for stamping with employer A I-797, visa approved, came to US. But after two and half month employer A cancelled my H1b due to some issue. My questions are 1) Employer A visa is valid till 2015 after H1b cancellation? 2) To get status, can i go out of the country and come back with employer A visa and employer B I-797 or do i need to go for stamping with employer B I-797 petition? Thanks.
Attorney_11 Posted February 22, 2013 Report Posted February 22, 2013 The US CBP permits a noncitizen to apply for H-1B classification when they are the beneficiary of an approved H-1B petition for the employer they intent to work for and are in the possession of a valid H-1B visa, even if the visa is annotated with the name of a previous employer.
