Recently I have transfered my h1 to new employer and my I797 is valid until sep'2014. I am going to India in may for my marriage. I have few questions over here. 1) Do I need to go for visa stamping since I changed my employer? 2) If not needed, can my wife to go to stamping with passport visa papers which is valid but show my old employer name and new I797? Any information regarding this, please let me know. Thanks in advance.
itsmeusa Posted February 21, 2013 Report Posted February 21, 2013 1. No, your H-1B visa from previous employer would help you re-enter US. You may need to show new employer's H-1B petition approval notice at the time of POE. 2. Yes, definitely.
