rahul1450 Posted February 18, 2013 Report Posted February 18, 2013 I am making $5849 below my prevailing wage that came in PWD determination during the PERM process. The perm is approved and now is the I-140 filing stage. I wanted to know when it is required that I be paid at least equal to prevailing wage i.e., before I -485 is filed or after I-485 is approved? Thanks, Rahul
Attorney_25 Posted February 18, 2013 Report Posted February 18, 2013 The wage offered on the PERM and I-140 is not required to be paid until your I-485 is approved. However, the employer needs to show ability to pay that wage for the entire process.
rahul1450 Posted February 20, 2013 Author Report Posted February 20, 2013 Thanks Attorney_25 for the quick response.
sumitsingh83 Posted February 22, 2017 Report Posted February 22, 2017 Is the prevailing wage once established during PERM/I-140 process remains constant or does it change every year till I-485?
