kchokkal Posted February 18, 2013 Report Share Posted February 18, 2013 I am currently on H1 and stamped with my previous employer(I-797) on Passport. I am going to get married soon. So if my spouse go for stamping by that time i should have my current employer stamping or is that old one should be fine. Is there any chance of 221G for my spouse ? Link to comment

It is advisable to consult with an immigration attorney to review, prepare and determine what issues, matters, or facts need to be clearly explained to the Consular Officer's queries. It is permissible for an applicant to apply for an H-4, so long as they have documentation describing the full details of the principal H-1B nonimmigrant's status maintenance or eligibility. Attorney_25 Posted February 18, 2013 Report Share Posted February 18, 2013 You are not even required to have a valid, unexpired visa in order for your wife to be issued a visa. This would not cause a 221g. She could get 221g if the consulate has questions about your current employment, but that rarely happens. If she does have problems, a qualified immigration attorney should be able to help resolve them. Link to comment
