h1_seeker
Hello My 6th year H1B expires in Sep 2013. How many days before expiration am I required to apply for H1B extension? Is it true that I am fine as long as my H1B extension petition reaches USCIS before expiry of H1B? Link to comment
sudhirreddy
You can apply it 6months ahead. It takes 2 months to get LCA approval then you file for h1b extension. Once they receive your h1b package you're good for 240days. You should get the decision before that. Link to comment
wiweq
"My 6th year H1B expires in Sep 2013." => To get H1b in 7th year, you employer should start filing your GC. To get capped H1b, you need to be outside of USA for one year. Link to comment

Attorney_25
Generally an extension request must reach USCIS no later than the day your prior I-94 expires. There must be a valid legal basis for requesting an extension. You may want to consult with a qualified immigration attorney to determine whether you are eligible for an extension. Link to comment
h1_seeker
Attorney_25 I have approved I-140 based on which I will extend my H1B. I need to travel to India in June 2013 and was wondering if it is okay to apply for H1B extension in July 2013 after I return back to US. Please advise if it is okay to travel abroad in June 2013? Thanks. Link to comment
