For the first 4 years of my H1B visa, I worked with employer A. He started Green card process and I got I-140 approved. Then I moved to employer B in fifth year and he too started GC process in my 6th year and currently there was a query on my Labor. So before completing my 6 years of H1b my employer (B) filed for H1B extension by using I140 of employer A and my petition is apporved for another 2 and half years based on I-140. Currently, employer A is asking me to work with him by transferring my H1b to him else he is saying that he will cancel my I-140. I am not interested to work for employer A. My question is, 1) what happens to my approved H1B, if he cancels the I140. 2) I am planning to go to India after 2 months and I have to attend visa stamping at that time. Will my stamping be denied if I-140 is cancelled. 3) Should I go to Canada quickly and have my visa stamped before he cancels the I-140. Your advice is highly appreciated. Thank you in advance. Raj
