vijayendhar
Hi All, My offer letter from employer says i get paid around 70k but the W2 form has a number greater than 70k as i had perdium and am paid on% basis. What should be our answer for the question 'How much is your salary ?' Is there a problem if W2 AMT is greater than the salary on the offer letter or LCA ? Thanks Link to comment
JoeF
For an H1, you can not be paid on a pure percentage. You need to get paid even if you don't have a project, and what's the percentage of 0??? You always have to get paid the salary as listed on the LCA. Any percentage can only be on top of that. vijayendhar
Hi Thanks for your answers. Yes shiv as you mentioned this is quiet a common thing. So can you please tell me if i get asked that question just in case shud my answer be the amount of 70k as on the LCA or the 100k as on the W2 ?. Atleast suggest what can be a better answer and how i can support my answer ? JoeF fortunately i was never on bench hence i do not have that problem of not having a paycheck while on bench. I heard that even if i am on bench if my W2 amount is greater than LCA then i am good. I am not sure how far that is true though. Link to comment
Hank_82
JoeF is correct .. You cannot have % basis for H1b ... You need to have fixed salary .. It is ok to have your W2 salary more than LCA, but you could be questioned why it is more? -- bonus, overtime ? You need to be careful for answering this ... Link to comment
