Green Process Doubts:

Recommended Posts

I landed US in June 2008

My 5ht year completes on June 2012

My employer is offering full time position. If he files a Green Card in 6th year(June or July month), what are all the challenges will i face?

Do i need to get Both Labor and I140 should be approved?

If the labor is approved and I140 is pending (my 6th year completes) what will happened?

if the labor is approved and I140 is Rfe (my 6th year completes) then what will happened?

Labor itself Rfe, and my 6th year completes what will happened?

If my labor is approved will i get one year extension and If I140 is approved will i get 3 years extensions? am i right?

Thanks

Madhu

In order to extend beyond the sixth year in H-1B classification, an individual must be the beneficiary of a PERM filed more than one year before the end of the 5th year, or an approved I-140 in a backlogged immigrant category. For personalized application of general legal principles, please contact a qualified immigration attorney for a legal consultation.
