Shailusudha Posted February 7, 2013 Report Posted February 7, 2013 I am on my 8th year of my H1b. I have an approved I140 with company A (priority: July 2009). I transfered to company B in 2011 - with the approved 140 i got 3 years of extenstion. I recently found that company B can't start my GC process. At this time can I transfer my H1B to company C using my I140 approved via company A?
Attorney_11 Posted February 7, 2013 Report Posted February 7, 2013 The law does not prohibit utilizing a previously approved I-140 in a backlogged immigration category filed by a previous employer to establish eligibility for extensions beyond the sixth year in H-1B with an employer different from the one that filed the I-140.
