However due to my pregnency I couldnt work. My due date is on 3/1/2013. I dont have my payrolls running. I dint apply for SSN. Now my concern is, for my husband to file taxes I should have ITIN number or SSN. Please help us regarding my status in US. Thank you in advance Poornima Link to comment

Attorney_25 Posted February 6, 2013 Report Share Posted February 6, 2013 If you have an SSN you should use it. If not, an ITIN should be acceptable. You can find information on obtaining an ITIN at IRS.gov. You may want to speak to an attorney about your current status issue. It can be resolved if handled properly. Link to comment
binoca82 Posted February 8, 2013 Report Share Posted February 8, 2013 Was your H1 approved as a COS (approval came with I94)? If yes, your status changed to H1 on that date, and since you are not working, you may be out of status. Or are you on unapid leave ? If it was not approved a COS, you are still on H4. You can apply for SSN if H1 was approved as a COS. If not, you need to get ITIN. Link to comment
