I was laid off in 2009, November and there was a three weeks to one month gap before I got my new job. My second employer filed for my H-1B transfer in 2009 and was approved. During this phase I was out of status for three weeks to a month. In December 2011 I moved to a third company and my H-1B was transferred without any problem. Since 2009 I have been to India twice and had no problem reentering US. Last November I went to H-1B stamping and had no problem with visa stamping. Now I am planning to apply for my Green Card through my third employer. I am concerned about the three weeks to one month gap between my jobs in 2009. I am wondering if this gap will affect my green card processing. I really appreciate any input. Link to comment
Attorney_11 Posted February 5, 2013 Report Share Posted February 5, 2013 Each case is different, but generally, re-admissions to the United States have the effect of rectifying previous minor status violations for future nonimmigrant visa extensions and permanent resident applications.
