kart1234 Posted February 4, 2013 Report Posted February 4, 2013 Hi, I am currently on H1 and going to canada for VISA stamping on March 4th at toronto consulate. I also have B1 from my previous employer valid until 2017. Can I re-enter to US with B1 in case if I stuck in canada on 221g or Administrative processing? Once I entered, Can I work in US on B1 untill my H1 issues are solved? Do I need any specific letter from my current employer supporting my entry based on B1? Please help Thanks
JoeF Posted February 4, 2013 Report Posted February 4, 2013 They will cancel the B1. And you can't work for your US employer with a B1, anyway.
Attorney_25 Posted February 5, 2013 Report Posted February 5, 2013 The B-1 might not be cancelled, but you certainly cannot use it to "work" for the H-1B employer. The B-1 has limited uses for business purposes which generally do not include "working." If you attempt to use the B-1 to enter to work for your new employer, you will most likely to be turned around, and possibly with a finding of misrepresentation or invalid entry document.

Arvinder Vemula Posted February 6, 2013 Report Posted February 6, 2013 Be prepared to answer questions about your B1 visa. Mine was also a similar case i was on B1 and later on moved to H1. I am also an FTE with all required documents. But still the VO asked me questions about B1Visa, education and issued 221g. So prepare well and attend.
