ajayt Posted February 4, 2013 Report Posted February 4, 2013 Hi, I have applied for H1B for 2008 cap and my petition got select in lottery and its valid upto 2011, and i met with an accident in 2008 and recovered also due to global economical crisis i haven't appeared for visa interview during its validity period (did not book any slot). Now i am interested to apply for H1B 2014.So do I need to apply new H1B under 2014 CAP or can i apply for new H1B from different sponsor before 01-APR-13 under CAP EXEMPT(with my old petition). wiweq Posted February 5, 2013 Report Posted February 5, 2013 You can go with different employer's H1b. This will be cap exempt. That means no need to wait for April 1st or Oct 1st.
ajayt Posted February 5, 2013 Author Report Posted February 5, 2013 Thanks Wiweq clarifying. If i go with new employer, will it be a like fresh H1b from 2013 (as a new petition for 4 yrs) or it will be renewed for remaining period on old H1b?
