znybrny Posted February 2, 2013 Report Posted February 2, 2013 Hello, My sister is a citizen and is getting ready to file for my mother's immigration when she visit here on the visit visa. In going through the checklists, i had some confusion so i'm asking more experienced readers to guide/clarify. Is the birth certificate a must or will a non-availability affidavit do? She was born before 1970 so in such a case what are acceptable proven alternatives? The non-availability affidavit will obviously be from india, is it acceptable? Attorney_11 Posted February 6, 2013 Report Posted February 6, 2013 Consult the US Department of State visa reciprocity page, which can be googled from the internet. A birth certificate is a must. If it is not available, a non-availability certificate and secondary evidence such as affidavits from individuals with personal knowledge of the applicant's birth and other contemporaneous evidence of birth date, alienage and parentage must be submitted.
