pavankalavagunta Posted February 1, 2013 Report Share Posted February 1, 2013 Hi, Here are my case details : I am on H1B Visa from Employer A. My H1B visa in passport expired in October 2010. My I-94 is valid till April 2014. My Wife is on H4. She travelled to India in 2012 and got a new visa stamping in India from Employer A as her H4 visa also expired in October 2010. She got her new H4 visa stampted till April 2014 in passport. I transferred my H1 to New employer B in January 2013. My new H1B (I797) is valid till April 2014. My wife also got new H4 (I797) from Employer B. Now we are planning to go to India. I am going for stamping with my New I797 from Employer B as my Visa from Employer A expired. My question is : does my wife also needs visa stamping from Employer B as my new visa will be from Employer B. Could anyone please advise. Thanks, Pavan. Link to comment

rangadu Posted February 4, 2013 Report Share Posted February 4, 2013 No. She already has her visa stamped till Apr 2014, she can use that one. In fact she did not even need a new H4 when you changed employers, not sure why you did it. Link to comment
