About Visa expiry and passport renewal

Hi

I was on H1 and I94 expiry date is July 20, 2013 which is also my passport expiry date.

Recently i changed my status to H4 and is valid till Dec 06, 2013.

I didn't get new I94. I am going to apply for New passport now.

When i get the new passport,

Do i have to go for stamping as visa(H1) expires in July? I mean do i have to compulsorily leave USA?

or Do i have to go for I94 extension?

My H4 is valid till Dec 2013.

Appreciate any help on this.

If you did not get I94 with H4 approval, your petition is approved for consualr processing and your are out of status now. If you are still in US, you must leave ASAP ! Get H4 stamped abroad then return to US.
