shruti.visa Posted February 1, 2013 Report Share Posted February 1, 2013 I might get laid off in next 3 days. It depends on one of the positions where I have been interviewed for by the client. In case it goes through, they will keep me in the job else they will lay me off effective 5th Feb. Please let me know the below 1) If I file for a change of status to B2 on Monday and I get the project where I have been interviewed, Can i continue working on H1b without making any changes or my H1 b will be cancelled once B2 is filed/ approved. 2) If i wait to hear back from the client and I dont get the project, Can i file for a change of staus after I am laid off. JoeF Posted February 1, 2013 Report Share Posted February 1, 2013 You could prepare the I-539, and only send it once you know if you are getting laid off or not. It can be sent at the last day. Link to comment
wiweq Posted February 1, 2013 Report Share Posted February 1, 2013 Don't wait till your lay off. Get your I539 ready and file on the day of lay off. In the case you get H1b sponsor soon or carry on with the same employer you can cancel the B2 by writing an application to USCIS. Link to comment
