My H1B petition withdrawn

Hi,

Thanks in advance.

I came to US in June 2012 on H4.

My husband's employer filed H1 visa for me in June 2012.

But in December 2012, employer has withdrawn my petition as my husband left the employer.

As my petition is neither approved nor rejected, I just wanted to confirm if new employer can file a new H1 for me(with 2012 quota)

or do I need to wait till April 2013 quota.

Please advice.

If the petition wasn't approved, you haven't been in the quota (it would have been the 2013 quota, btw.) A new H1 can only be filed from April 2013 on, in the quota for fiscal year 2014, with a start date of Oct. 1, 2013.
