Hi,

Currently I am working as a consultant and my current employer(say company A) is not going to file my green card. I am on H1B visa having almost 2 1/2 years left to finish up the total 6 years. My wife is working as a fulltime( say company B). Is it possible that company B can file my green card even though I work for company A. What happens if my H1B visa got over after 2 1/2 years, do I get extension if I get I-140

-Thanks

GC processing is for a future job, so you do not have to be working for the company at the time for GC application, so to answer your question, yes Company B can file for your GC while you are working for Company A, you should then join Company B upon the GC approval.

Yes you can get H1B extended beyond 6 yrs with an approved I-140.
