H1B & L2 got approved the same day - Validity

Hi,

My wife was working on L2 as a dependant on my L1B in a company. When my L1B was going through extension, it took longer than expected and her EAD(provided for L2) expired. Due to this, her company had filed for a H1-Premium.

Both the applications for her (L2 and her H1-Premium) were approved the same day 01/05/2012. Please find more details below:

Visa Type : L2 Extn

Receipt Date : 5/25/2011

Notice Date : 1/5/2012

Valid From : 1/5/2012

Valid Until : 6/21/2013

Visa Type : H1 Premium

Receipt Date : 9/22/2011

Notice Date : 1/5/2012

Valid From : 1/5/2012

Valid Until : 9/30/2014

She has not traveled to India after the above 2 petitions being approved until now, so there is no stamping yet.

1. Which Visa is currently valid?

2. Could you please advise if she definitely need to get her H1-Premium visa stamped before June to continue to work in US on her H1 visa?

Because both petitions were approved on same day, she has the choice to choose one and maintain that status. Contact an attorney before taking decision.
