mnirmaljeet
I moved back to India in Aug 2011, 6 months before completing my 6 years on my H1B then. My I-797 expired in Fed, 2012. Now (in Jan, 2013), I have a excellent opportunity coming my way. The company says that I can easily transfer my visa since 6 months are still available on my old visa. Additionally, the company also says that since I have stayed in India for more than a year, they would be easily able to get me an extension for another 3 years once the available 6 months expire. Since I will be moving my family along with me, I want to be sure that the extension will be possible after 6 months. Can someone please confirm if this is possible or will there be any complications since I don't want to come back again after 6 months? Link to comment
binoca82
If you want to get a fresh H1 6 years term, you need to process the new H1 under the cap and must stay 1 year outside. --This is my personal opinion. Link to comment
needh1bextension
Did you have any luck? I am in a similar situation. I did find this link which says it's possible. http://www.**************.html You can also re-capture the time spent on vacations - it seems. Link to comment
