Can she travel outside and get her J1 visa stamping renewed? Will it be an issue to get her J1 stamping renewed, since I had filed for her i-140? Please suggest our options. I don’t have to appear for visa interview since I have valid US visa. But if she leaves outside country, she has to renew her J1 visa and get stamp so please suggest what our options and what’s wise thing to do are Thank you Link to comment
jairichi Posted February 1, 2013 Report Share Posted February 1, 2013 I believe it will be a tough case as she has shown intention to immigrate (contrary to the purpose of J1 visa) as you had filed I-140 on her behalf. I would suggest you to avoid any travel outside US till she gets a H1B or a H4. This is my opinion from what I have read in forums. Ask an attorney to be sure. Link to comment
