On Feb 6th 2012 I went to Ottawa, Canada for my H1-B visa extension stamping (2nd H1-B Valid till Sep' 2014) and unfortunately got 221g-white as I don’t have the client letter. Now I'm working in India and this company is filing my visa under cap exempt. Now the problem is, this company is warning me about the stamping due the pending 221g case in Canada. Will this be an issue when I go for stamping with the new petition? Should I go for new H1-B or the transfer under cap exempt with this company? Please advice… Thanks in advance. Link to comment
DonShady Posted January 24, 2013 Report Share Posted January 24, 2013 it should not be an issue, make sure you give the VO geuine and honest answers. there is nothing like 'h1b transfer', moreover since you dont have an i94 u are out of h1b status which means it is a new h1b petition Link to comment
