Currently on H-1B; H-1B transfer petitions from two companies.

Hi Folks,

I am currently on H-1B and working for company A.

Recently I got an offer from company B and sent them my documents for H-1B transfer. Then later, I got another offer from company C (better salary, better benefits) and they are asking me to send the documents for the visa transfer.

*** I still did not get any receipt or approval from company B. They have done the normal/regular processing.

So my concerns here are:

1) Is it legally allowed or possible for company C to transfer my Visa, as company B has already kick-started the transfer process?

2) Will I be in any problem if I choose to go with company C?

3) Will there be any legal status issues if I opt for company C?

Any help is highly appreciated.

Every H1b petition is independent of other H1b petitions. You give your current valid H1b’s details to your future employer to file your H1b. IN you case you are currently maintaining your legal H1b status with employer A. Provide company's A H1b documents (I797, pay stubs) to C to file your H1b petition. You are not maintaining your H1b with B so they are not in the picture.
