KBob Posted January 24, 2013 Report Posted January 24, 2013 Hello I joined a desi employer X on OPT and didn't sign any contract with the employer X. After working for 8 months, the X company was acquired by another desi company Y X company sent an email saying all the services, contracts and time sheets will be taken care by the new company Y. They messed up one of my friends H1B application and it was rejected, so after working for 2 months with Y company, I moved out of Y But Client and Vendor remained same and I didn't sign any non compete agreement Now Y company sent an email as Legal Notice saying that Breach of Contract and X company gave power to Y company to take legal action during acquisition and I have pay $15000 if I want to settle outside court and should respond in 5 days If not it will be escalated to court for further action Please advise, do I have to take any action regarding that email. What I have to do if they send a legal notice through attorney Note: I didn't sign any contracts with my X company or Y company Thanks

JoeF Posted January 24, 2013 Report Posted January 24, 2013 That's a scare tactic. Giving just 5 days to answer is not going to fly in any court. That's undue pressure. It takes longer than that to just discuss the situation with a lawyer. You should still schedule an appointment with a labor lawyer to discuss this.

venky144 Posted February 1, 2013 Report Posted February 1, 2013 u can re sue the employer who sent ur the notice saying u were harassed or stuff....if u dont want to take risk...ask them breach of contract or just stay silent and dont do anything...nothing will happen....
