DKPK Posted January 23, 2013 Report Posted January 23, 2013 Hello, I live in US on H4 visa for the past 51/2 years. My sixth year visa is ending in June 09 2013. Iam travelling to India in May and would like to return in the month of July. My husband is not travelling so he will be applying I-129 H-1B - Specialty occupation - Extension of stay in the U.S. based on I140 approval. In this case what should i do? Will I have to apply for new H4 visa to travel back to US? Please let me know the procedure. Thanks DKPK
rrr2008 Posted January 24, 2013 Report Posted January 24, 2013 Since your visa is expiring on June 09, you need to go for visa stamping in India with your husband's H1 approval.

rrr2008 Posted January 25, 2013 Report Posted January 25, 2013 Correct, since you are going to India for stamping, it is not necessary for you to apply for new I797 for H4. But make sure that your husband's I797 was done before you leave to India, other wise instead of enjoying the fun time in India, we keep on thiking about that.
