I have done my masters in the US and worked on a H1-B visa until December2011.I had to go back to India as I was ut of status. However, I got my petition reaffirmed after one year. I have only 1month left on my status i.e., my H1B expires in March2013. Iam planning to come back to US in February 1st Week. Please let me know, whether I'll have any problems at port of entry. Would be great if someone can help ASAP.. Thanks, Vishal
shandan Posted January 23, 2013 Report Posted January 23, 2013 Hi Vishal, What do you intend to do with the 1 month stay in the US? I do think you would need to be prepared to explain the IO at POE, why do you want to come to US on H1B for just a month?

shandan Posted January 24, 2013 Report Posted January 24, 2013 Ask your employer to file for an extension prior to you coming to US and get the receipt of the application, so atleast you will have something to show to the IO to that effect. The extension can be filed 180 days in advance from the expiry date of H1B, so there is nothing holding your employer from filing an extension.
