neerajbioxford Posted January 23, 2013 Report Posted January 23, 2013 Also I just wanted to know, in worst scenario if I dont get my PERM approved within my H1b expiration, would my labor process be dropped as soon as i leave US or it would continue and I still have the chance to come back after my PERM approval. shandan Posted January 23, 2013 Report Posted January 23, 2013 If by the time your H1B expires you have your labor application pending for 365 days or more, then you can file for a 1 yr extension for H1B based on the pending labor application. If your labor application is not filed yet or has been pending less than 365 days prior to your H1B expiration, then again whether or not you are in the country or not has no bearing on your GC process, as the GC process is for a future job, so it can continue no matter where you are in the world.
