Processing times are unpredictable. Currently, a PERM process takes 3 to 5 months for certification after filing. This time frame does not take into account the minimum 60 days that the advertising for a PERM must go on and US applicants must be considered prior to filing. An I-140 can be filed premium processing, which can get an answer within 15 days of filing.

You may want to discuss with your attorney whether you might have H-1B time left to recapture. You are permitted a full 6 years inside the US in H-1B status. Time spent outside the US, on vacations etc., is not counted toward your 6-year stay. You may in fact want to travel outside the US soon so that you will have time to recapture afterwards. Please discuss any travel plans with a qualified attorney before implementing.
