I was wondering if my PERM and I-140 would get approved on time? Should I keep up my hopes or start packing up my bag? Though my company attorney is saying we are still on target. Please advice! Attorney_11 Posted February 6, 2013 Report Share Posted February 6, 2013 Processing times are unpredictable. Currently, a PERM process takes 3 to 5 months for certification after filing. This time frame does not take into account the minimum 60 days that the advertising for a PERM must go on and US applicants must be considered prior to filing. An I-140 can be filed premium processing, which can get an answer within 15 days of filing. Link to comment

Attorney_25 Posted February 15, 2013 Report Share Posted February 15, 2013 You may want to discuss with your attorney whether you might have H-1B time left to recapture. You are permitted a full 6 years inside the US in H-1B status. Time spent outside the US, on vacations etc., is not counted toward your 6-year stay. You may in fact want to travel outside the US soon so that you will have time to recapture afterwards. Please discuss any travel plans with a qualified attorney before implementing. Link to comment
