Can I travel while my H1B is being processed and come back in oct after stamping

Hi,

Im on OPT till may2013 and my wife was denied F2 visa on 214b. I read through many forums and have a feeling that there are very slim chances of getting either F2 or B2 visa for her.

My Question is, can I apply for H1B and ask my company to allow me to work from India till October so that I can live with my wife and once H1b gets processed, apply H4 for my wife and get both of our visas stamped in October 2013 and come back to US ?

Please help.

That is perfectly acceptable if your company would permit it.They are not required to do so.

one more follow up question I have. If I extend my OPT and file for H1 and get it my may 2013 by premium processing, can I re-enter US on OPT? The intention behind this is, if I just file H1 and get it by May I cannot go to India for a short trip from April to October and re-enter. But if I have something like valid OPT, I can at least travel and re-enter multiple times from April to Oct. Please tell me if this is the correct assumption.
