planind1234
Hello, I am currently working on L1 B visa and is seeking a conversion to L1A visa. I was working for the same company for 1 year in Canada as software developer, later I got transferred to US branch in 2009 on L1B visa, i had no management experience while i was at Canada. Now in US, i'm working as Project Leader and 5 people report to me on a daily basis. My visa will expire on Oct 2013. Company is fine for conversion to L1A.I want to know the possibilities of L1A conversion approval. My Questions: · Is it fine not having the management experience outside the country for the conversion L1B to L1A? · If L1A conversion gets rejected, can I still continue my stay on the basis of valid L1B petition · Once it is approved could it possible to change the EB2 category to EB1 category.( At present my Labor was approved) Thanks in advance! Attorney_23
A foreign national does not need to have managerial/executive experience abroad to be eligible for L1A. However, such experience is required for EB-1 for multinational executives/managers. Link to comment
planind1234
Thank you very much and appreciate your response. With that said there is no issue for L1A transfer. But it is an issue for transfer of EB2 to EB1. What are the chances for me to convert to EB1 Or do I need to remain in EB2 category for the GC process. Your response is greatly appreciated. Attorney_23
If a foreign national has no executive/managerial experience abroad, s/he does not qualify for a EB-1 for multinational executives/managers. Link to comment
