Jet Posted January 17, 2013 Report Posted January 17, 2013 Hi All, I have a quick question regarding the client relocation clause. When the client office is relocated within 30miles, there is no need to file for an h1b amendment or update LCA? Is it true?
Attorney_10 Posted January 18, 2013 Report Posted January 18, 2013 Generally, the Department of Labor regulations do not require a new LCA to be certified if the work location changes within the same metropolitan statistical area and notices are posted at the new location prior to moving the H1B beneficiary to the new worksite. These regulations are very complex and there are many exceptions and limitations to these regulations, which should be discussed with an experienced immigration attorney prior to making any changes to the H1B holder's employment. Depending on the individual circumstances a new certified LCA and an H1B amendment may be required.
