optforum Posted January 16, 2013 Report Posted January 16, 2013 Hi, I was rejected my H1-B Visa under "212 a (6) c" in 2007 for falsely representing I was working for a company for some period. [After verification they found my experience with that company was false and then rejected my H1B visa]. And in 2011 my second H1B application was again rejected as I was already ineligible (in first H1B application) under "212 a (6) c" and I was told that I do not get visa anytime. recently I have sent a mail to consulate with my details and asked for waiver of ineligibility. They have sent a reply to me saying I can go for an option to request for a waiver under INA 212(d)(3)(A). And they provided the below url for help http://travel.state....ities_1364.html And I found some info in below url too. http://www.state.gov...ation/87150.pdf Could you please provide the details on process for requesting under INA 212(d)(3)(A) ? And possibilities of waiver ? how much time does the process take ? and any other details which will help me in proceeding further on waiver request ? Thanks a lot in advance for your help
