ukhry Posted January 11, 2013 Report Posted January 11, 2013 Hi, I am on L1b visa for employer-1 and currently working on L1 visa only. Empoyler-2 applied for H1B visa in 2012. Got an RFE in OCT and my employer replied back in Dec for the same. Now we are waiting for the Approval. My question is - As per employer-B I can legally work on H1b visa while I am waiting for approval. Is is true?
Attorney_10 Posted January 11, 2013 Report Posted January 11, 2013 Generally, an individual applying for a change of status from one work visa to another work visa must wait until the change of status is approved and the start date on the petition takes effect before s/he may work for the new employer in the new status.
