(moderators please move to appropriate sub forum if incorrectly posted) I have an approved I-140 from my employer under EB3, with a PD of June 2010. I now wish to pursue a fulltime MBA. I plan to file for a COS from H1 to F1. My question is if there is a way for me to retain my GC filing with the PD? From what I have read online and on the forums, an F1 visa means I do not intend to migrate (confusion here over answering the qsn in the forms regarding "Has anyone filed for a migrant visa for you etc"). So what happens to my current GC filing? If I find a job after my MBA, can the new employer then file for a GC for me under EB2 with the same PD? Has anyone been in a situation like this or dealt with one? Is a part time/executive MBA my only choice? I am into consulting and travel a lot so an Exec MBA will be a tough choice. JoeF Posted January 10, 2013 Report Share Posted January 10, 2013 With a pending or approved I-140, it is pretty much impossible to get an F1. The reason is that an I-140 shows that the person has immigration intent, which is not allowed for an F1. Link to comment
