rhanik Posted January 7, 2013 Report Posted January 7, 2013 Hi, I came on F1, completed MS, OPT and first year of H1B. Now, am I a resident alien or still a non resident alien? Please help me to understand.
wiweq Posted January 7, 2013 Report Posted January 7, 2013 Google "resident alien IRS international students". There are many articles with examples on this.
JoeF Posted January 7, 2013 Report Posted January 7, 2013 You are most likely a tax resident. Check IRS Publication 519, Tax Guide for Aliens. The check for "Significant Presence" is explained there.
Attorney_23 Posted January 7, 2013 Report Posted January 7, 2013 The terms "resident alien" and "nonresident alien" can mean different things, depending upon the context. However, questions surround these terms usually come up when people have questions regarding their tax status. For those types of questions, you would typically use the IRS' definition of the terms, which can be found here: http://www.irs.gov/Individuals/International-Taxpayers/Determining-Alien-Tax-Status
KK_US Posted January 8, 2013 Report Posted January 8, 2013 if u r on H1B, working in US...I believe u will be identified as "Resident Alien".

insignia6 Posted March 13, 2014 Report Posted March 13, 2014 Hi rhanik, What options did you dial for getting to customer representative of USCIS. I wasn't able to connect to them. Actually I had to ask about my status. I was on F1 from Aug 2010 to Sep 2013. And then on H-1b visa Oct 2013 onwards. I was out if US for 21 days around Nov-Dec 2013. So what would be my status. Resident Alien or Non-resident Alien and what form do I need to file? 1040 or 1040NR Thanks, insignia6
JoeF Posted March 13, 2014 Report Posted March 13, 2014 You can check IRS Publication 519, Tax Guide for Aliens.
maverickp Posted March 14, 2014 Report Posted March 14, 2014 insignia6, you're still a resident alien for tax purposes. Fill out the 1040.
