Employer A revoked my petition/visa. Now I am moving to India on Feb 2013 for my marriage and will be back in same month. Visa with my Employer A shows the validity of Sep 2013. 1) Can I enter using old Visa or do I need to go for Re-stamping before entering into US ? If I schedule my interview now for Re-stamping so as I am single now I will fill DS160 as single. After my marriage if I got marriage certificate on time and assuming appointment is available before my return, I would like to do H4 stamping as well. 2) Can I resubmit the form as married and apply for H4 Visa as well ? 3) Do I need to repay the fees for H1 Visa or do I need to pa only for H4 Visa ? Petition is employer's and can be revoked, Visa is yours and has not been revoked. 2 and 3) Just apply H4 visa, no need for H1. Marriage certificate doesn't take much time, at most 2-3 days if you are persistent. Link to comment
