labour was not filed prior to 365 day of my H1B, need help

hi every one,

my labour was not filed prior to 365 days of h1b expiry. my labour was approved and filed I-140, i got REF on my 140, my attorney filed a new 140 instead of answering the ref, it is still pending and my h1b is going to expiry in june 2013. I cann't go for 7th year extention as the labour in not filed before the 365 days of h1b.

I am worried about my situation

Attorneys please suggest me what is my next step.
