Is a student on OPT eligible to received W9 form from his employer?

Hi,

If an international student is in it's OPT period and he finds a part-time job related to his major but his employer don't want to show him as his employee but he wants to show him as a contactor of his firm. So my question is that is he eligible to work as an contractor even though if he doesn't have any business open under his name. And also that is he eligible to received W9 form from his employer?
