Manan choksi Posted January 2, 2013 Report Share Posted January 2, 2013 Hi, I am on opt extension right now and its just started from this January 2013 and it will be expired on 1 jun 2014. Now I want my company to file H1 for me. Will it be okay if they will file my H1 for fiscal year 2015 because I want to use my full OPT extension time. As per USCIS, i can work if my opt extension has expired and H1b file in process. Or Should I ask my company to file my H1 for fiscal year 2014 . Please answer my question... Link to comment
catx Posted January 2, 2013 Report Share Posted January 2, 2013 In immigration matters taking action sooner is almost always better than later. If you wait and there are any issues or problems (unforeseen or otherwise), you could find yourself with an expiring visa / I-94, and having to leave your job and leave the U.S. Early planning and action are the best course. Further, if you intent is to pursue permanent residency (green card), then getting a H-1B visa as soon as possible and your employer filing a PERM labor certification application for you at the earliest opportunity is advisable.
