Techny Posted December 17, 2012 Report Share Posted December 17, 2012 Hi, I am planning to go to Canada or Mexico for H1B stamping. This is my 3rd time getting the visa stamped. Previous stamping expired in April 2009 (More than 3 yr ago) but I have never been out of status, and have been holding H1B since 2005. My current renewal is valid till April 2015 and I have all my valid I-797s and I-94s. Just a side note, in case it is relevant - I have been on H1B for almost 7 years and got my recent extension based on the approved I-140. Questions 1) If I go to Mexico, I am concerned about the requirement they have for visa validity - it says on the website "The visa must be valid or have expired within the last year." Since my visa expired more than 3 years ago, I am not sure if the condition applies on me and if I might get into trouble? 2) If not Mexico, is Canada the best choice for me? I'll really appreciate if someone can share similar experience and give some advise. Thanks! Link to comment

In your case if you have seen their website clearly states that your visa expiry should not be more than a year. why do you want to go and risk your self. Try going to Canada, that will be a better choice. Link to comment
